Discrimination
No University
student or employee shall, on the basis of age, be excluded from
participation in, be denied the benefits of, or be subjected to
discrimination under any University program or activity.
University
Students
For University students, applicable federal civil rights law prohibits
discrimination on the basis of age. Unlike federal and state laws
protecting employees, there is no minimum age requirement for students
to be protected under applicable age discrimination laws.
University
Employees
For University employees, applicable federal and state civil rights
laws prohibit discrimination on the basis of age for persons who
are 40 years of age or older. Age discrimination in the employment
context applies to compensation, terms, conditions, or privileges
of employment. Examples of discrimination based on age include,
but are not limited to:
- denying
raises, benefits, promotions, or performance evaluations on the
basis of the person's age.
- preventing
any person from using University facilities or services because
of a person's age.
- denying
a person access to any educational program based on a person’s
age.
- harassing
or retaliating against an employee for filing a complaint or helping
another person file a complaint of discrimination based on age.
- fostering
an environment that is unwelcoming or hostile based on a person's
age.
